Tribunal Claim / Final Judgment

  1. 1 Whether the Respondent is indebted to the Claimant for the outstanding loan balance and accrued interest.
  2. 2 Whether the Claimant is entitled to the claimed sum, costs, and interest as prayed.

Ratio Decidendi

The Tribunal found that the Respondent was duly served but failed to enter appearance or file a defence. The Claimant's evidence, including the loan statement and the Respondent's written admission of indebtedness, was uncontroverted. The Tribunal accepted the Claimant's computation of the outstanding loan balance as Kshs. 460,504 as per the latest loan statement. In the absence of any defence or challenge to the claim, and in light of the Respondent's own admission of liability, the Tribunal entered judgment for the Claimant for the sum of Kshs. 460,504 plus costs and interest from June 2023.
