The 1st to 3rd Respondents were served with the Petition and accompanying Motion and acknowledged service. They failed to file a response within the time prescribed by the Rules and did not take advantage of the additional opportunity granted by the Court to file and serve their responses and submissions. The reasons advanced for the failure to comply were not sufficient, and the Respondents had two clear opportunities to defend the Petition but failed to do so. The Court, therefore, declined to exercise its discretion to set aside the judgment or grant leave to file responses out of time, as the Respondents had not demonstrated sufficient cause or interest in defending the Petition.
