More fundamentally, the applicant had not sought or obtained the mandatory leave to appeal from the High Court's decision in a succession matter, as required by law. Without such leave, the applicant had no right of appeal, and the application to deem the appeal as properly filed and served was a nullity. The court therefore dismissed the application with costs to the respondents.
