Ratio Decidendi

The court found that the applicant had complied with all procedural requirements, including serving the bill of costs and other processes. There was no evidence of any dispute as to retainer or any active participation by the respondent to challenge the application. The certificate of costs had not been set aside or altered. Applying Section 51(2) of the Advocates Act and the holding in Musyoka & Wambua Advocates v Rustam Hira Advocate, the court exercised its discretion to enter judgment for the applicant for the sum certified in the certificate of costs, together with interest from 30 days after the date of the certificate.
