Ratio Decidendi

The court found that, given the applicant's involvement in a previous matter before the same judge, where the judge made a finding of perjury leading to criminal charges against the applicant, there exists a reasonable perception of partiality or conflict of interest. To maintain public confidence in the judiciary and ensure fairness, the judge determined it was proper and prudent to recuse himself from further conduct of the matter. The application for recusal was therefore allowed, and the matter was directed to be placed before another judge for hearing and determination.
