The subordinate court imposed a default custodial sentence of two years in the event of non-payment of a Kshs 100,000 fine for the offence of being in possession of forest produce without authority. However, the Forest Conservation and Management Act prescribes a maximum custodial sentence of six months for this offence. The High Court, exercising its revisionary jurisdiction under sections 362 and 364 of the Criminal Procedure Code, found the default sentence unlawful as it exceeded the statutory maximum.
