Ratio Decidendi

The court found that the applicant lacked locus standi to bring the application or to institute the intended appeal because he had not produced a grant of letters of administration or any legal instrument appointing him as the legal representative of the deceased's estate. The authority to act, dated prior to the deceased's death, only permitted him to act on her behalf while she was alive and incapacitated, not after her death. As a result, the court held that it could not entertain the application for extension of time to appeal, regardless of the merits of the intended appeal, and struck out the application with costs to the interested party.
