Ratio Decidendi

The Tribunal found that there was no evidence of a valid notice to terminate the tenancy as required by Cap 301, rendering the respondents' attempts to evict the applicant unlawful. The lease agreement and payment evidence established a landlord-tenant relationship solely between the applicant and the 1st respondent. The 2nd and 3rd respondents failed to prove any direct landlord-tenant relationship or valid claim for rent arrears. The Tribunal's jurisdiction does not extend to ownership disputes, only to matters arising from controlled tenancies. Accordingly, the applicant was entitled to protection from eviction and interference, and to costs, which were awarded to him.
