The trial court imposed an unlawful sentence of three years imprisonment for personation under section 382(1) of the Penal Code, which is classified as a misdemeanour punishable by a maximum of two years imprisonment under section 36 of the Penal Code. The appellant's status as a repeat offender does not justify a sentence exceeding the statutory maximum. The appellate court, exercising its supervisory and revisionary jurisdiction, set aside the illegal sentence and substituted it with the lawful maximum of two years imprisonment for each count, to run concurrently.
