Ratio Decidendi

The court found that the correction sought by the Plaintiff would substantially alter the character and intent of the original ruling delivered by Okwengu J., as the ruling was based on the deponent named therein, John Muriuki Kibuchi, not Samuel Patrick Kibuchi. Section 99 of the Civil Procedure Act only allows for correction of clerical or arithmetical mistakes or accidental slips, not substantive changes to a judgment or order. Furthermore, such corrections should be made by the judge who issued the original ruling. Since the amendment sought would go beyond correcting a clerical error and would instead change the substance of the ruling, the court declined to grant the application....
