Ratio Decidendi

The court found that, in view of the pending application for stay of execution and the nature of the prayers sought, it was prudent to grant a conditional stay of execution of the judgment and decree of the trial court. The stay was granted on the condition that the appellant deposits the entire decretal sum in court within thirty days. Failure to comply would result in the dismissal of the application for stay. The court exercised its discretion under Order 42 Rule 6 of the Civil Procedure Rules and the inherent powers under Sections 1A, 3, and 3A of the Civil Procedure Act to ensure the appeal is not rendered nugatory and to balance the interests of both parties.
