Civil Application / Ruling on Application to Strike Out Notices of Appeal

  1. 1 Whether the respondent's notices of appeal were filed and served within the statutory time limit of 14 days after judgment.
  2. 2 Whether the existence of two notices of appeal in respect of the same judgment constitutes an abuse of the court process.

Ratio Decidendi

The Court found that both notices of appeal were filed outside the 14-day period required by Rule 77(2) of the Court of Appeal Rules, 2022, following the judgment delivered on 9th April 2021. The respondent did not seek leave to file out of time or to extend the period for filing. The existence of two notices of appeal in respect of the same judgment was deemed an abuse of the court process. The Court emphasized the importance of adhering to procedural timelines for the orderly administration of justice and held that failure to comply with such timelines attracts consequences, including striking out the notices. Accordingly, the application to strike out both notices of appeal was allowed.
