The tribunal found that the sub-tenancy agreement between the applicant and the Respondents, dated 26.9.2019, was for a fixed term of three years and expired by effluxion of time in September 2022. There was no evidence of mutual extension of the tenancy. The applicant's act of paying rent directly to the landlord after expiry did not create a new tenancy, as the lease only permitted such payment during the life of the sub-tenancy. The applicant's continued occupation after expiry rendered him a trespasser. The tribunal further held it lacked jurisdiction to compel the main landlord, who was not a party to the proceedings, to enter into a tenancy with the applicant. Accordingly, the...
