Ratio Decidendi

The court held that since the plaintiff died on 22 October 2018 and no application for substitution was made within one year as required by Order 24 Rule 3 of the Civil Procedure Rules, the suit abated by operation of law. Once a suit abates, it ceases to exist and there is no subject matter capable of being transferred to another court. Therefore, the application to transfer the suit was dismissed as there was no longer any suit pending before the court. The absence of opposition from the respondents did not alter the legal position regarding abatement and the lack of a transferable subject matter.
