The appellate court held that, as at the time the respondent filed the application for costs, there was no formal judgment on record in the lower court. The respondent had not applied for judgment on admission, and the lower court had not entered any judgment. The trial court therefore erred in holding that costs follow the event in the absence of a judgment or determination. The payment of the principal sum by the appellant did not amount to a judgment or determination by the court. Consequently, the respondent was not entitled to costs at the time they were awarded.
