The two previous suits cited by the defendant were not discontinued; one was dismissed and the other struck out. Therefore, the rule does not apply to the present circumstances. Even if the rule were applicable, the court retains discretion in granting a stay, and there are sufficient mechanisms within the rules for the defendant to recover costs from suits determined otherwise than by discontinuance.
