Ratio Decidendi

The trial court erred in imposing a default sentence of five years imprisonment for non-payment of a fine of KShs 1,000,000. Section 28(2) of the Penal Code expressly limits the maximum default sentence for fines exceeding KShs 50,000 to 12 months unless another written law provides otherwise. The Wildlife Conservation and Management Act, 2013 does not expressly provide for a longer default sentence. Therefore, the five-year default sentence was unlawful. The High Court substituted the default sentence with the lawful maximum of 12 months imprisonment in default of payment of the fine, thereby partially allowing the appeal against sentence.
