The Supreme Court held that the applicant filed his petition of appeal out of time without first seeking and obtaining leave of the court to extend the time for such filing. Under the Supreme Court Rules, a record of appeal must be filed within 30 days of the notice of appeal. The applicant filed his appeal 16 days out of time and did not seek extension for the late filing of the substantive appeal. As a result, there was no valid petition of appeal on record, and the application for extension of time to file a supplementary record of appeal was not anchored on any valid proceedings.
