Ratio Decidendi

The court found that while the respondent had a valid and fair reason to terminate the claimant's employment based on the claimant's conduct and the content of the SMS, the respondent failed to follow the mandatory procedural requirements under section 41 of the Employment Act. The claimant was not given an opportunity to be heard or to defend himself before dismissal. This procedural lapse rendered the termination unfair within the meaning of section 45 of the Act. The court therefore awarded the claimant compensation for unfair termination and salary in lieu of notice, taking into account the claimant's contribution to his dismissal and the relatively short period of service.
