The court found that the defendant, facing a substantial decretal sum and with the plaintiff being a foreigner, had demonstrated sufficient cause for a stay of execution pending appeal, as there was a real risk of substantial loss if the stay was not granted. However, the court also held that the security deposited by the plaintiff was only for the hearing of the suit and not for the appeal, and with judgment entered in the plaintiff's favour, there was no justification for continued holding of that security. The stay of execution was therefore granted on condition that the defendant provides adequate security for the due performance of the decree, specifically Kshs.200 million by bank...

Orders

  • The security given by the plaintiff pursuant to the order of 24th September, 2004, and invested in Barclays Bank of Kenya Ltd under Certificate No.507380, shall be refunded to the plaintiff.
  • There shall be a stay of execution pending appeal on condition that the defendant provides security in the sum of Kshs.200 million by bank guarantee or other security acceptable to both parties within thirty days.
