Ratio Decidendi

The High Court lacks jurisdiction under Section 18 of the Civil Procedure Act to transfer a suit from the Chief Magistrate's Court to the Industrial Court, as the provision only allows withdrawal of proceedings from subordinate courts to the High Court itself, not to another subordinate court or tribunal. The application for transfer is therefore misconceived and must fail. The proper course for the applicant is to withdraw the suit from the Chief Magistrate's Court and file a fresh claim in the appropriate court, once established under the Constitution. The application is dismissed with costs to the respondent.
