Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether a party can pursue both a review and an appeal against the same judgment or decree.
  2. 2 Whether the appellant, having sought review, was entitled to lodge an appeal on the same judgment.
  3. 3 Whether the appeal was properly before the court and could be heard on its merits.

Ratio Decidendi

The court held that the law and judicial precedent are clear that a litigant cannot pursue both a review and an appeal in respect of the same judgment or decree. The appellant, having filed an application for review of the judgment delivered on 28/05/2019, thereby abandoned the right to appeal that judgment. The proper course would have been to appeal the ruling on the review application, not the original judgment. Consequently, the appeal was not properly before the court and could not be heard on its merits. The appeal was therefore struck out with costs to the respondent.

Court Disposition
