Ratio Decidendi

The court held that the right of a party to withdraw its suit is absolute and cannot be denied by the court, subject only to the issue of costs. The applications and petition were found to be spent following the AGM and decree in the ELC case. The court found that Order 25 Rule 1 of the Civil Procedure Rules applies, allowing withdrawal of the petition and applications. The court further held that upon withdrawal of the petition, all subsisting orders issued in the suit are automatically vacated, rendering the respondents' application to set aside such orders spent. The respondents were awarded costs of the petition and the application.
