The trial magistrate erred in dismissing the preliminary objection on the basis that the matter had already proceeded and that the court had jurisdiction by virtue of transfer from the ELC. The statutory provisions require that such disputes be first determined by the Land Registrar, and the court should not have entertained the suit before exhaustion of that process.
