Ratio Decidendi

The court found that the claimant's cause of action arose in August 2015 when the decision to surcharge her was made. The claim was filed on 22nd December 2020, more than five years after the accrual of the cause of action. Section 90 of the Employment Act provides a strict three-year limitation period for employment-related claims, with no provision for extension. As such, the court held that it lacked jurisdiction to entertain the claim, which was therefore struck out. The interim order previously granted was vacated, and each party was ordered to bear its own costs.
