Leave to appeal was therefore mandatory. The appellant did not seek or obtain such leave, either at the time the order was made or within the prescribed period. The court held that the requirement for leave is a jurisdictional matter, not a mere procedural technicality, and cannot be cured by article 159(2)(d) of the Constitution.
