Ratio Decidendi

The court found that the appellant filed the memorandum of appeal nearly two years after the ex parte judgment and over a year after the ruling dismissing his application to set aside, without seeking or obtaining leave to appeal out of time as required by Section 79G of the Civil Procedure Act. There was no evidence on record of any order granting such leave, nor any explanation for the delay.
