The court found that the trial court erred by detaining the applicant's vehicle as security beyond the statutory forfeiture procedure outlined in the Criminal Procedure Code. The law requires that, upon forfeiture of a recognizance, the court must first seek to recover the bond amount from the surety. Only if the surety fails to pay or the amount cannot be recovered should the court proceed to attach and sell the property offered as security. Since the applicant was willing and able to pay the full bond amount of Ksh. 70,000, there was no legal justification for continued detention of her vehicle.
