The Court of Appeal found that while the applicants may have an arguable appeal on the issue of whether the High Court erred in making a partial distribution of the estate without an application for such distribution, they failed to demonstrate that their appeal would be rendered nugatory if stay of execution was not granted. The estate is substantial, all parties are beneficiaries, and the distribution of the funds does not preclude the applicants from pursuing their appeal or from receiving their rightful share.
