Ratio Decidendi

The Tribunal determined that while it has jurisdiction to hear disputes between members of a co-operative society under section 76 of the Co-operative Societies Act, the claimants lacked locus standi to institute the proceedings on behalf of Manmo Sacco Ltd. The Sacco, as a body corporate, is the proper party to sue or be sued in matters concerning its business. The claimants, having brought the suit in their own names and not as the Sacco, did not have a sufficient legal interest in the subject matter to confer standing. Consequently, the preliminary objection was upheld and the claim was struck out with costs to the respondents.
