Procedural Posture

Stay Application / Ruling on Interlocutory Application for Stay Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of implementation of the decree and orders pending appeal.
  2. 2 Whether restricting dealings with the suit land pending appeal is justified.

Ratio Decidendi

The court found that the applicant demonstrated a real risk of substantial loss if evicted from the suit land while the appeal was pending, as he had resided there for over 30 years with his family. The court held that maintaining the status quo would not prejudice the respondents, as the land would remain intact should the appeal fail. The court concluded that the interests of justice required granting a stay of implementation of the decree and restricting dealings with the suit land pending the hearing and determination of the appeal. Accordingly, the application was allowed in terms of the specified prayers, with costs in the cause.

Court Disposition
