The court found that while customary trust is recognized as an overriding interest under Section 28 of the Land Registration Act, the plaintiffs, particularly the sisters, did not object to the subdivision and transfer of the suit land in 1985 and were not in occupation. The court held that the long delay of over 29 years before bringing the claim rendered it stale and overtaken by events, especially as the land had been subdivided, transferred, and partly sold to third parties. The plaintiffs failed to prove their claim on a balance of probabilities, and the court dismissed the suit, ordering each party to bear their own costs due to their sibling relationship.
