The court held that entry of judgment on the taxed costs under Section 51 of the Advocates Act is premature because a reference challenging the taxation is pending and undetermined. Consequently, the application for a garnishee absolute order is also premature and cannot be granted until the reference is resolved. However, the court found it prudent to preserve the sum of Kshs 1,022,218.00 by directing that it be deposited with the court pending the outcome of the reference application, given the applicant's legitimate expectation to recover his fees and the absence of any proposal from the respondents to settle the debt.
