Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion to Strike Out Defence and Enter Judgment

  1. 1 Whether the respondent's statement of defence raises any triable issues.
  2. 2 Whether the claimant is entitled to judgment for the liquidated sum claimed plus interest and costs.

Ratio Decidendi

The tribunal found that the respondent's statement of defence amounted to mere denials and did not raise any triable issues. The respondent failed to comply with tribunal orders, did not file written submissions, and did not attend mentions, indicating no intention to contest the claim. Applying Order 10 Rule 4 of the Civil Procedure Rules, the tribunal held that in cases of liquidated claims where the defence is a sham or the defendant fails to substantively defend, judgment should be entered for the claimant. Consequently, the tribunal struck out the respondent's defence and entered judgment for the claimant for the sum claimed, with interest and costs.
