Procedural Posture

Miscellaneous Application / Ruling on Application for Judgment on Taxed Costs

  1. 1 Whether judgment should be entered for the applicant based on the certificate of taxation.
  2. 2 Whether the respondent has properly challenged the taxing officer's decision under the Advocates Act and Advocates Remuneration Order.
  3. 3 Whether proceedings should be stayed pending determination of the respondent's reference.

Ratio Decidendi

The court found that the respondent had indeed filed an application (reference) challenging the decision of the taxing officer in a separate miscellaneous application, as permitted under the Advocates Remuneration Order. The applicant did not dispute the existence or competency of this reference. The court held that, in the circumstances, it would be unfair to enter judgment for the applicant while the respondent's challenge to the taxed costs was pending. Therefore, the court stayed further proceedings on the applicant's motion for judgment until the determination of the respondent's reference. Each party was ordered to bear its own costs for the application.

Court Disposition

Application for judgment stayed pending outcome of respondent's reference.

Orders

  • Further proceedings on the applicant's motion dated 28.8.2017 are stayed pending the outcome of Misc. Application No. 250 of 2017.
  • Each party to bear its own costs of these proceedings.
