The court held that the legal and evidential burden of proof had shifted to the appellant, who failed to provide a credible explanation. On quantum, the court agreed with the appellant that the multiplier of 35 years was excessive given the deceased's occupation as a casual labourer, and substituted it with a multiplier of 25 years.
