The respondent, despite being served, failed to oppose the application or provide any justification for non-payment. The court held that the respondent has a public duty to pay the decretal sum as recognized by the Intergovernmental Relations Technical Committee and as mandated by law. Accordingly, the court granted an order of mandamus compelling the Secretary, County Government of Kiambu, to settle the outstanding decretal amount, and awarded costs to the applicants.
