  1. 1 Whether there existed a marriage between the applicant and the respondent and if so whether the same has been dissolved.
  2. 2 Whether the properties in question are matrimonial property.
  3. 3 Whether the applicant is entitled to the reliefs sought including injunction and declaration of interest.

Ratio Decidendi

The court found that the applicant failed to prove the existence of a marriage with the respondent, as required by law. Both parties were married to other individuals under statute, and there was no evidence of dissolution of those marriages or of a valid marriage between the applicant and respondent. Without proof of marriage, the properties listed could not be classified as matrimonial property under the Matrimonial Property Act. Consequently, the applicant's claim for declaration of interest and injunction over the properties could not stand. The court dismissed the originating summons and awarded costs to the respondent.
