Procedural Posture

Miscellaneous Application / Judgment

  1. 1 Whether the grant of representation was obtained fraudulently or by concealment of material facts.
  2. 2 Whether the distribution of the deceased's estate was in accordance with the law.
  3. 3 Whether non-beneficiaries and creditors were improperly included in the distribution.

Ratio Decidendi

The court found no sufficient grounds to revoke the grant, as there was no evidence of fraud or material concealment in its issuance. However, the court determined that the distribution of the estate was not in accordance with the law, as non-beneficiaries and creditors were included among those allocated shares. The court held that only the children of the deceased (as beneficiaries) are entitled to inherit, and that creditors must be settled by the administrator before distribution. The share of a deceased beneficiary may devolve to their child. Accordingly, the court set aside the previous distribution and ordered a lawful redistribution of the estate.

Court Disposition

Application for revocation of grant dismissed; distribution set aside; redistribution ordered.

Orders

  • The application for revocation of grant is dismissed.
  • The previous distribution of the estate is set aside.
