Procedural Posture

Succession Cause / Ruling on Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of proceedings pending the hearing and determination of the appeal in the Court of Appeal.
  2. 2 Whether there was inordinate delay in filing the application for stay of proceedings.
  3. 3 Whether the applicant demonstrated sufficient prejudice to warrant a stay of proceedings.

Ratio Decidendi

The court found that the applicant failed to explain the inordinate delay of approximately six months in filing the application for stay of proceedings after the ruling was delivered. The memorandum of appeal was also filed three months after the ruling, and the application for stay was only made after the respondent filed for confirmation of grant. The applicant did not sufficiently demonstrate how she would be prejudiced if the stay was not granted. In the absence of a satisfactory explanation for the delay and lack of demonstrated prejudice, the court exercised its discretion to dismiss the application for stay of proceedings.
