The Plaintiffs withdrew the suit after 17 years without providing any explanation or justification. There is no evidence that the 2nd Defendant's conduct, either prior to or during the proceedings, contributed to the litigation or would justify depriving him of costs. Under Section 27(1) of the Civil Procedure Act, costs ordinarily follow the event, and there is no reason to depart from this principle. The 2nd Defendant is therefore entitled to the costs of the suit. Furthermore, under Section 27(2) of the Civil Procedure Act, the court has discretion to award interest on costs.
