Procedural Posture

Land Dispute / Judgment After Formal Proof; Default Judgment Against Defendant

  1. 1 Whether the Plaintiff is the registered proprietor of the suit land and entitled to exclusive possession and enjoyment of the same.
  2. 2 Whether the Defendant has trespassed on the Plaintiff's land without lawful justification.
  3. 3 Whether the Plaintiff is entitled to a permanent injunction and removal of structures erected by the Defendant.

Ratio Decidendi

The Plaintiff established through documentary evidence that she is the registered proprietor of the suit land, entitling her to exclusive possession, occupation, and use. The Defendant, despite being served, failed to file a defence or rebut the Plaintiff's claim. The Land Registration Act confers absolute ownership and quiet enjoyment to the registered proprietor, and the Defendant's occupation and erection of structures on the land was without consent or legal basis. There was no evidence of fraud, misrepresentation, or illegality in the Plaintiff's title. The Plaintiff is therefore entitled to the orders sought, including a permanent injunction and removal of the Defendant's structures...

Court Disposition

Judgment for the Plaintiff. Permanent injunction granted. Defendant to remove structures within 30 days or Plaintiff to do so at Defendant's cost. Costs awarded to Plaintiff.

Orders

  • A permanent injunction restraining the Defendant from trespassing or entering the suit land title No. MITUMBIRI/WEMPA/BLK.2/4132 or otherwise interfering with the Plaintiff’s quiet possession.
  • The Defendant to remove the structures erected on the suit land within 30 days from the date of judgment, failing which the Plaintiff may remove them at the Defendant’s cost.
