The evidence established that the land was family land, originally belonging to Kiganda Muthiguro, and was registered in the name of the eldest son, Muthiguro Kiganda, during demarcation in 1957, in accordance with Kikuyu custom. Both families had lived on the land for over 60 years, with the Plaintiff’s family occupying the eastern part and the Defendant’s family the western part, and there was no dispute until succession proceedings commenced.
