The omission, whether intentional or accidental, constituted an error that could be rectified under the law. The court held that the omission of Margaret Wambui Kamuri was a correctable mistake and that Gladys Wairimu Kamuri, as the widow, was entitled to a life interest in the estate. The court therefore allowed the application for rectification, ordering that Margaret Wambui Kamuri be included as a beneficiary to share the land equally and that Gladys Wairimu Kamuri be granted a life interest.
