The prayers for a surveyor to visit the properties, point out beacons, and ascertain development status were deemed final in nature and not suitable for determination at the interlocutory stage. Given the existence of a parallel suit (ELC 130 of 2019) raising similar ownership issues, and the fact that the applicant's title was contested, the court held that it would be premature and prejudicial to grant the orders sought.
