Ratio Decidendi

The court found that the subject property had already been sold by public auction in exercise of the statutory power of sale prior to the present application. The purpose of a temporary injunction is to prevent an event from occurring, not to reverse an event that has already taken place. Since the auction and transfer of the property had already occurred, granting an injunction would serve no practical purpose and is not an appropriate remedy. The court also noted that similar relief had previously been sought and determined, and that the propriety of the auction sale is a matter for trial, not for interlocutory relief. Accordingly, the application for a temporary injunction was declined.
