Ratio Decidendi

The delay was not inordinate and did not prejudice the petitioner. The error in procedure was curable, and it would be unjust to lock out the respondent from the proceedings. Therefore, the proceedings conducted as an undefended cause were set aside, and the matter was directed to proceed as a defended cause.
