Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the summary dismissal of the claimant amounted to unfair termination.
  2. 2 Whether the claimant is entitled to the reliefs sought including compensation, salary in lieu of notice, accrued benefits, and certificate of service.

Ratio Decidendi

The court found that the claimant was dismissed on the basis of unproven allegations and was not afforded a fair hearing as required by Sections 41 and 45 of the Employment Act. The respondent failed to attend court or provide evidence to justify the dismissal or demonstrate that a fair procedure was followed. The court held that the dismissal was both procedurally and substantively unfair. Consequently, the claimant was entitled to compensation for unfair dismissal, salary in lieu of notice, accrued leave, service pay, and a certificate of service. Claims for reimbursement of petty cash and refund of unremitted PAYE were dismissed for lack of evidence.

Court Disposition

Judgment for the claimant.

Orders

  • The respondent shall pay the claimant Ksh.470,166.70 plus costs and interest.
  • The respondent shall issue the claimant with a certificate of service.
