Ratio Decidendi

The court held that although Lore & Company Advocates had filed a notice of change of advocate, they failed to serve it on the Defendant's counsel and the Plaintiff's former advocate as required by Order 9 Rule 5 and 6 of the Civil Procedure Rules. Service of the notice is a mandatory procedural requirement, and until it is effected, the previous advocate remains on record. Consequently, Lore & Company Advocates were not properly on record when they filed the notice of motion dated 13th April 2016. The court found merit in the Defendant's preliminary objection and struck out the notice of motion for being filed by a stranger to the proceedings. Costs were awarded to the Defendant.
