Miscellaneous Cause / Ruling on Application for Recognition of Arbitral Award

  1. 1 Was there an arbitration hearing between the parties as required by law?
  2. 2 If so, did it result in an enforceable arbitral award?
  3. 3 Who should bear the costs of the application?

Ratio Decidendi

The court found that the applicant failed to present any written arbitration agreement or clause as required by Section 4 of the Arbitration Act. The statements relied upon by the applicant in the SSB's decision did not constitute an arbitration agreement. The court held that arbitration is a consensual process and cannot be imposed in the absence of a valid agreement. Since there was no arbitration agreement, there could not have been an arbitral process or an enforceable award. Consequently, the application for recognition of the alleged arbitral award was unmerited and was dismissed with costs to the respondent.
